Welcome to Profragrance. These Terms of Service ("Terms," "Terms of Service," or "Agreement") govern your use of the Profragrance website, online store, and any purchases made through our store.

By accessing our website, creating an account, placing an order, or purchasing products from Profragrance, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase products from us.

Profragrance is an independent fragrance retailer and reseller. We are committed to providing authentic fragrances and a positive shopping experience for our customers.

1. About Profragrance

Profragrance is a Florida-based fragrance retailer offering authentic full-size fragrances, fragrance decants, and fragrance samples.

Our fragrances are sourced through legitimate commercial distribution channels and distributors. We represent that products sold by Profragrance are authentic products sourced through our business supply channels and are not counterfeit fragrances.

Profragrance is an independent retailer and is not affiliated with, sponsored by, endorsed by, or otherwise officially associated with the individual fragrance manufacturers or brand owners whose products may be offered through our store unless expressly stated otherwise.

All trademarks, brand names, logos, and product names belong to their respective owners.

2. Products and Product Descriptions

We make reasonable efforts to ensure that product names, descriptions, photographs, sizes, colors, packaging details, and other information displayed on our website are accurate.

However, manufacturers may change packaging, bottles, labels, boxes, formulations, or other product characteristics from time to time. Accordingly, the physical appearance of a product may differ slightly from photographs displayed on our website.

Fragrance performance, longevity, projection, and scent perception can vary from person to person. Individual experiences with a fragrance are subjective and may be affected by skin chemistry, environment, application method, storage, and other factors.

A difference in personal preference, performance expectations, scent perception, or longevity does not by itself constitute a product defect.

3. Authenticity

Profragrance takes authenticity seriously.

We source our products through legitimate commercial distribution channels and make reasonable efforts to ensure that the products we sell are authentic.

We do not intentionally sell counterfeit fragrances.

If you have a genuine concern regarding the authenticity or condition of a product you received, please contact us promptly with your order information and relevant photographs or other documentation so that we can investigate the matter.

4. Decants and Samples

Profragrance may sell fragrance decants and samples containing portions of fragrances originally manufactured by third-party fragrance brands.

A decant is a portion of fragrance transferred from an original fragrance bottle or source container into a separate smaller container for sampling or personal use.

Unless expressly stated otherwise:

  • A decant is not the original manufacturer's retail bottle.

  • The decant container and labeling are provided by Profragrance.

  • The fragrance contained within the decant is sourced from authentic fragrance inventory.

  • Purchasing a decant does not provide ownership of, or affiliation with, any third-party trademark or brand.

  • Brand names are used only to identify the fragrance contained in the decant.

Because decants and samples involve the transfer of fragrance into a separate container, they are subject to the return restrictions described in these Terms.

5. Pricing

All prices displayed on our website are subject to change without notice.

We reserve the right to correct pricing errors, typographical errors, product descriptions, or other inaccuracies.

If a product is listed at an obviously incorrect price due to an error, Profragrance may cancel the affected order and provide a refund of any amount paid for that product.

Applicable sales tax and other legally required charges may be added to orders based on applicable law.

6. Promotions, Discount Codes, and Influencer Codes

Profragrance may offer promotional pricing, discount codes, influencer codes, limited-time offers, or other promotions.

Unless otherwise stated:

  • Promotions may have expiration dates.

  • Promotional codes may not be combined.

  • Promotional codes may be limited to certain products or orders.

  • Promotional codes may have minimum purchase requirements.

  • Promotional codes may not be exchanged for cash.

  • Profragrance reserves the right to discontinue or modify a promotion, subject to applicable law.

  • Promotions may not be applied retroactively to previously completed purchases unless expressly authorized by Profragrance.

Specific promotional terms displayed with an offer will control if they conflict with these general Terms.

7. Orders and Order Acceptance

Placing an order through our website constitutes an offer to purchase the selected products.

An order confirmation or receipt does not necessarily mean that Profragrance has accepted the order.

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including in circumstances involving:

  • suspected fraud or unauthorized payment;

  • inaccurate or incomplete customer information;

  • inventory errors;

  • pricing or listing errors;

  • suspected resale abuse;

  • unusual or excessive purchasing activity;

  • payment-processing problems;

  • shipping restrictions; or

  • other circumstances permitted by applicable law.

If we cancel an order after payment has been collected, we will issue an appropriate refund for the canceled merchandise.

8. Order Cancellations

Customers may request cancellation of an order before the order has entered our fulfillment process.

Once an order has been processed, packed, and its shipping label has been purchased or generated, cancellation may no longer be possible because the order may be scheduled for shipment that same day or the following business day.

If an order has already entered fulfillment, Profragrance may be unable to cancel it.

Customers should contact Profragrance as soon as possible if they wish to request a cancellation.

Nothing in this section limits any cancellation or refund rights that cannot legally be waived.

9. Shipping

Profragrance currently ships orders within the United States only.

Shipping methods, estimated delivery dates, and shipping costs will be presented during checkout when available.

Shipping and delivery estimates are estimates and are not guaranteed unless expressly stated otherwise.

Once an order has been shipped, delivery is handled by the applicable shipping carrier. Carrier delays, weather events, transportation disruptions, incorrect customer addresses, and other events outside Profragrance's reasonable control may affect delivery times.

If Profragrance becomes unable to fulfill an order within a legally required or expressly promised timeframe, we will handle the situation in accordance with applicable law, which may include notifying the customer of a delay and providing applicable cancellation or refund options.

10. Shipping Restrictions for Fragrance Products

Many fragrances contain alcohol and may be classified as flammable materials for transportation purposes.

Profragrance will select shipping methods and packaging intended to comply with applicable carrier and transportation requirements.

Certain shipping services, destinations, or transportation methods may not be available for particular fragrance products.

Customers agree not to request or require Profragrance to ship products using a method that violates applicable carrier, transportation, or hazardous-material requirements.

11. Delivery Address

Customers are responsible for providing a complete and accurate shipping address at checkout.

Profragrance is not responsible for delays, misdeliveries, returns, or additional shipping expenses caused by an incorrect, incomplete, outdated, or otherwise inaccurate address supplied by the customer.

If a package is returned to Profragrance because the customer provided an incorrect address or failed to accept delivery, additional shipping charges may apply before the package can be reshipped.

12. Lost, Stolen, or Misdelivered Packages

After an order has been properly packaged and transferred to the shipping carrier, delivery is generally controlled by the carrier.

If tracking information indicates that a package was delivered to the address provided by the customer, Profragrance is not responsible for theft or loss occurring after delivery.

Customers should use a secure delivery location and monitor tracking information.

If a package is marked as delivered but cannot be located, customers should first check the delivery location, household members, neighbors, building management, and any applicable carrier delivery information. Customers may also contact the carrier to open an investigation.

Profragrance may, at its discretion, assist with carrier investigations or provide information necessary to pursue a shipping claim.

Nothing in this section excludes any rights or remedies that may apply under applicable law or any protection provided by a shipping service, payment provider, or other applicable program.

13. Damaged, Leaking, or Incorrect Orders

We take care when packaging fragrance products for shipment.

If your order arrives damaged, leaking, broken, materially defective, or contains the wrong product, contact Profragrance as soon as reasonably possible after delivery.

We may request photographs or other information, including:

  • photographs of the shipping box;

  • photographs of the shipping label;

  • photographs of the damaged product;

  • photographs of any leakage or breakage;

  • photographs of the product packaging; and

  • other information reasonably necessary to investigate the issue.

This information may be used to determine whether the issue occurred before shipment, during transportation, or after delivery.

Customers should not dispose of damaged products or packaging before contacting Profragrance if the materials may be necessary for an investigation or shipping claim.

Profragrance reserves the right to investigate suspected fraudulent, abusive, or dishonest claims.

14. Returns and Refunds

Because fragrances are personal-use products and may be affected by hygiene, contamination, tampering, or product-integrity concerns after opening, Profragrance accepts returns only under the conditions described below.

Eligible Returns

A return request must generally be made within 14 calendar days of delivery.

To qualify for a return:

  • The product must be unopened and unused.

  • The product must remain in its original condition.

  • Any original packaging, seals, boxes, labels, and accessories should remain intact.

  • The product must not have been sprayed, tested, worn, altered, transferred, or otherwise used.

  • The product must be returned in a condition that allows it to be resold.

Opened or Used Products

Opened, sprayed, tested, used, altered, transferred, or otherwise tampered-with fragrances are generally not eligible for return.

This includes full-size fragrances and decants/samples.

A customer may not open or use a fragrance and then return it simply because they do not like the scent, the performance, the longevity, or how it smells on their skin.

This restriction does not apply where applicable law requires a remedy for a defective, incorrect, or otherwise legally nonconforming product.

Return Authorization

Customers must contact Profragrance before sending a return.

Unauthorized returns may be refused or delayed.

Once a return is received, Profragrance may inspect the product to determine whether it meets the eligibility requirements.

If an eligible return is approved, the refund will generally be issued to the original payment method, subject to applicable payment-processing timelines.

Unless otherwise required by law or agreed by Profragrance, original shipping charges are not refundable.

Customers may be responsible for return shipping costs for discretionary returns.

15. Refund Processing

Approved refunds will be processed after the returned product has been received and inspected.

The time required for the refund to appear in a customer's account may depend on the customer's bank, credit-card issuer, payment provider, or other financial institution.

Profragrance is not responsible for processing delays caused by a customer's bank or payment provider after Profragrance has initiated the refund.

16. Exchanges

Unless expressly stated otherwise, Profragrance does not guarantee exchanges for fragrance products.

Customers seeking a different product may return an eligible unopened product in accordance with our Return Policy and place a new order.

Defective or incorrect products will be handled separately in accordance with Section 13.

17. Customer Responsibility for Product Use

Customers are responsible for using fragrance products according to their intended purpose and applicable product instructions.

Fragrances may contain alcohol, fragrance compounds, allergens, or other ingredients that may cause irritation or an allergic reaction in some individuals.

Customers should review applicable product information and exercise appropriate care before using a fragrance.

Profragrance does not guarantee that a particular fragrance will be suitable for every individual.

If irritation, an allergic reaction, or another adverse response occurs, discontinue use and seek appropriate medical advice when necessary.

18. Accounts and Customer Information

If you create an account with Profragrance, you are responsible for maintaining accurate account information and protecting the confidentiality of your login credentials.

You agree not to use another person's account without authorization.

Profragrance reserves the right to suspend or terminate accounts associated with fraudulent, abusive, unlawful, or otherwise prohibited activity, subject to applicable law.

19. Prohibited Conduct

You agree not to use our website or services to:

  • violate any applicable law or regulation;

  • commit fraud or payment fraud;

  • provide false or misleading information;

  • interfere with the operation or security of our website;

  • attempt to gain unauthorized access to our systems;

  • use automated methods to improperly access or collect website data;

  • abuse promotions, discount codes, refunds, or other offers;

  • submit fraudulent damage, delivery, or return claims;

  • impersonate another person or business; or

  • engage in conduct that could reasonably harm Profragrance, its customers, employees, partners, or service providers.

20. Intellectual Property

The Profragrance name, logo, original photographs, website design, written content, graphics, product descriptions, and other original materials provided by Profragrance are protected by applicable intellectual-property laws.

You may not reproduce, copy, modify, distribute, sell, publish, or commercially exploit Profragrance-owned content without our prior written permission.

Third-party trademarks, brand names, logos, and product imagery remain the property of their respective owners.

21. Third-Party Brands and Trademarks

References to third-party fragrance brands are made for product identification and informational purposes.

Profragrance does not claim ownership of third-party trademarks.

Unless expressly stated otherwise, the appearance of a brand name or product on our website does not mean that the brand manufacturer endorses, sponsors, partners with, or is affiliated with Profragrance.

22. Website Availability

We attempt to keep our website available and accurate, but we do not guarantee that the website will always be uninterrupted, error-free, secure, or available.

We may temporarily suspend or modify website functionality for maintenance, updates, security reasons, technical issues, or other operational reasons.

23. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and services are provided on an "as available" and "as is" basis.

We do not make warranties beyond those expressly provided by applicable law or expressly stated by Profragrance.

Nothing in these Terms is intended to exclude or limit warranties, consumer rights, or remedies that cannot legally be excluded or limited.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Profragrance and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of our website or purchase or use of our products.

To the extent permitted by applicable law, Profragrance's total liability arising from a particular purchase will not exceed the amount actually paid to Profragrance for the product giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited or excluded under applicable law.

25. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Profragrance and its owners, employees, contractors, service providers, and affiliates from claims, liabilities, damages, losses, costs, and expenses arising from your unlawful use of our website, violation of these Terms, fraud, or intentional misconduct.

26. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

Any dispute will be handled in accordance with applicable law and in a court or other forum having proper jurisdiction.

Nothing in this section is intended to deprive consumers of rights or remedies that cannot legally be waived.

27. Changes to These Terms

Profragrance may update these Terms from time to time.

When changes are made, the updated version will be posted on our website with a revised "Last Updated" date.

Your continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

29. Entire Agreement

These Terms, together with our applicable Privacy Policy, Return Policy, Shipping Policy, and other policies or terms expressly incorporated into these Terms, constitute the agreement between you and Profragrance concerning your use of our website and purchases from our store.
